President Donald Trump has suffered another setback in his attempt to revive a defamation lawsuit against CNN over the network’s use of the phrase “Big Lie” in reference to his claims about the 2020 election, which he lost to Joe Biden.
On Tuesday, a full panel of judges at the Atlanta-based federal appeals court declined to hear his case.
Trump had petitioned the full court after a three-judge panel rejected his suit in November. Notably, two of the three judges on that unanimous panel ruling were Trump appointees.
This appeal followed U.S. District Judge Raag Singhal’s dismissal of the suit in Florida in 2023. Judge Singhal, also a Trump appointee, ruled that the statements at issue were opinions rather than factually false statements, and that Trump had not demonstrated that CNN acted with actual malice.
